Terms of Service

These Terms of Service ("Terms") govern your use of the EFFLUX mobile application and website operated by EFFLUX ("we," "us," or "our"). By using our services, you agree to these Terms.

1. The Service

EFFLUX is a platform that transforms photographs into custom fragrances. You upload a photo, our AI pipeline extracts environmental data (location, weather, nearby places, vegetation), we ask clarifying questions, and then generate a unique scent formula. You may then order a hand-blended bottle of your fragrance.

2. Account Registration

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account.
• You must be at least 13 years old to use EFFLUX.
• One account per person. Accounts are non-transferable.

3. Photo Uploads

• You retain ownership of all photos you upload.
• By uploading a photo, you grant EFFLUX a limited license to process the photo and its metadata for the purpose of creating your fragrance.
• You must only upload photos you own or have permission to use.
• Do not upload photos containing illegal content.

4. Scent Formulas

Each formula generated by EFFLUX is unique. Formula IDs (e.g., EFX-2024-0847) are assigned automatically. While we strive for accuracy in scene reconstruction, results depend on the metadata available in your photo and the quality of third-party API data.

Fragrance perception is subjective. We do not guarantee that the scent will exactly match your memory of the moment photographed.

5. Orders and Payment

• Prices are displayed in USD and include the bottle, labeling, and standard shipping.
• Payment is processed securely by Stripe. We accept major credit cards and Apple Pay.
• Orders are hand-blended to your formula. Due to the custom nature of the product, all sales are final. We do not accept returns or offer refunds except in cases of damaged or defective products.
• If your order arrives damaged, contact us within 7 days for a replacement.

6. Shipping

• We currently ship within the United States.
• Estimated processing time is 5–10 business days for blending, plus shipping transit.
• You will receive push notifications (if enabled) when your order ships and is delivered.
• EFFLUX is not responsible for delays caused by shipping carriers.

7. Shared Memories

• You may generate a shareable link for any completed memory.
• Shared pages are publicly accessible to anyone with the link.
• Shared pages display your memory name, scene analysis, reconstruction data, and formula accords. They do not display your email, shipping address, or payment info.
• You are responsible for the content you share.

8. Demo Mode

EFFLUX offers a demo mode with pre-built sample memories. Demo mode does not require an account and does not send data to our servers. Demo data is not real and is provided for illustration purposes only.

9. Prohibited Uses

You agree not to:

• Use the service for any illegal purpose.
• Upload content that infringes on others' rights.
• Attempt to reverse-engineer our formulation algorithms.
• Abuse rate limits or access the API outside of the official app.
• Create multiple accounts to circumvent restrictions.
• Resell EFFLUX fragrances as your own product.

10. Intellectual Property

The EFFLUX name, logo, design system, and formulation engine are the intellectual property of EFFLUX. Your photos and personal data remain yours. The scent formula generated for you is licensed for personal use only.

11. Limitation of Liability

EFFLUX is provided "as is." To the maximum extent permitted by law, we disclaim all warranties, express or implied. We are not liable for indirect, incidental, or consequential damages arising from your use of the service.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app settings. Upon termination, your data will be handled according to our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
